First the bad news. If you get into arrears with your mortgage, your
lender will take out a CCJ (County Court Judgment) against you and
apply for a Repossession Order. You will be evicted and your credit
rating will be seriously affected making it difficult to even rent
elsewhere.
The good news is we may be able to help you. The most important thing
you must not
do is ignore it. You should contact your lender immediately and explain
your situation. It is not in anyones interest to go
through with a repossession - even the lender.
If it has gone further than this and the process of repossession has begun,
or you are about to be evicted try
the Citizens Advice Bureau. They may be able to put you in touch with
someone.
How can we help ? If you agree to sell to us, then a stay of
repossession from the court can be applied for. We can attend a court
hearing with you and show that a sale has been agreed. This should be
sufficient to stop, or at least delay, any eviction until completion of
the sale (within a reasonable timescale). If your lender knows you have
a buyer for your home which covers any outstanding debts they should be
prepared to postpone the repossession. Our solicitor will write to them
confirming our intention to purchase your property.
